A tiny house on wheels is a titled vehicle (Delaware's code distinguishes manufactured homes from travel trailers, recreational vehicles, park trailers and camping trailers), while a foundation-built or manufactured home is installed as a building and can be treated as real property.
State-specific note
There is no mandatory statewide building code. 16 Del. C. 7601 gives the Levy Court of Kent County and the County Councils of New Castle and Sussex the discretionary power to adopt and enforce building, plumbing and electrical codes, so the applicable edition depends entirely on which county you build in.
Delaware devolves building regulation to its three counties, and they have not moved in step: New Castle County runs the 2021 IRC effective January 2024, Sussex County the 2021 IBC and IRC effective January 2023, and Kent County the 2018 IBC and IRC with county amendments. The single statewide requirement is energy. County and municipal codes must meet the current IECC within twelve months of the Delaware Energy Office adopting it. On tiny homes specifically, Delaware is ahead of most states. Kent and Sussex each publish a requirements document for units of 400 sq ft or less excluding lofts, drawing on the IRC's tiny-house appendix, though the minimum habitable-area rules are not identical between them.
