Are tiny homes legal in every US state?
There is no national yes or no, because there is no national rule to answer it. Building codes are adopted state by state and enforced by local city and county building departments, so legality is really a question about your specific jurisdiction rather than your state. Most states have a workable path for at least one type of small home; what differs is which type, and under what conditions.

Two things move the answer most: whether the home is on wheels or on a foundation, and whether your jurisdiction has adopted the code provisions that make a small dwelling permittable, which is not uniform.
We publish a guide for 49 states and the District of Columbia, each with the building code in force, the climate and design values that govern construction there, and the sources we checked them against. Where something is unresolved, the guide says so instead of guessing.
The comparison table sets them side by side, and draws one distinction most code guides skip: whether a state's code reaches your build on its own, or whether that is a decision your city or county makes. In 12 of the 50 places we cover, no state-level residential code applies on its own.
