These Terms govern your use of kyraxhomes.com (the “Site”) and any quote, order, or purchase from KYRAX DEVELOPMENTS LTD. (“KYRAX”). By using the Site or engaging with us, you agree to these Terms.

1. Site content

All content on the Site — text, images, floor plans, specifications, branding — is owned by KYRAX or licensed to us. You may view and share links to the Site for personal, non-commercial use. You may not copy, reproduce, or redistribute Site content without written permission.

2. Quotes & pricing

Prices shown on the Site are starting prices in US dollars unless noted, and are indicative only. Your actual price depends on your configuration, destination, and delivery route, and is confirmed in a written quote after your consultation. Quotes are valid for 30 days from the date issued unless otherwise stated in writing. Material and transport costs can change; beyond the validity window we may re-quote.

3. Deposits & payment

Production begins only after a signed build agreement and deposit are received. Deposit amount, payment milestones, and final-payment terms are set out in each build agreement. Deposits are non-refundable once materials are procured, except where required by law or as separately agreed in writing.

4. Delivery & site prep

KYRAX delivers to sites across the United States and Canada using DOT-compliant carriers and highway permits arranged by our logistics team. You are responsible for: (a) confirming road access to the delivery point, (b) any required site preparation (pad, tie-downs, utility stubs), (c) securing any permits for placement on your property, and (d) any additional fees caused by access restrictions, delays, or re-routing that are beyond our reasonable control.

5. Warranty

Each KYRAX home ships with a written limited warranty specific to the build, describing covered components, warranty periods, exclusions, and claim procedure. Manufacturer warranties on installed appliances and systems (HVAC, solar, etc.) pass through to you. This Site content does not itself constitute a warranty.

6. Zoning, permits & codes

Building and zoning rules vary by municipality. Information on the Site about ADU laws, IRC Appendix Q, and permitting is a general summary and not legal advice. It is your responsibility to confirm with your local planning department that the home you order is permitted at your specific address. KYRAX will provide documentation to support your application but cannot guarantee local approval.

7. Financing

We may refer you to third-party lenders. We do not extend credit ourselves and are not responsible for the lender's underwriting decision, rate, or terms. Any financing agreement is between you and the lender.

8. Limitation of liability

To the maximum extent permitted by law, KYRAX's aggregate liability under these Terms, any build agreement, or your use of the Site is limited to the amount you have paid KYRAX for the specific home or service giving rise to the claim. KYRAX is not liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost savings, or loss of use).

9. Disclaimers

The Site is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site is error-free or uninterrupted.

10. Governing law

These Terms are governed by the laws of the Province of British Columbia and the applicable laws of Canada, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of British Columbia unless you are a US resident, in which case we will in good faith discuss a US-state forum convenient to both parties before proceeding.

11. Changes

We may update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Continued use of the Site after changes constitutes acceptance.
